OK Rescinds All Calls for a Con/Con!

Governor Brad Henry this week signed SJR 11, the bill rescinding all applications to the U.S. Congress for a  constitutional convention (or Con/Con).  SJR 11 was authored by Sen. Randy Brogdon and Rep. John Wright.

According to research done by OK-SAFE, since statehood Oklahoma has passed 10 resolutions calling to amend the U.S. Constitution, with two of those actually calling for Constitutional Convention  for the U.S. Constitution.

  1. 1976 –  HJR 1049 reads:

“A joint resolution concerning the budget of the United States; the purpose of requesting appropriate action by the Congress, either acting by consent of two-thirds of both Houses or, upon application of the legislatures of two-thirds of the several states, calling a Constitutional Convention to propose an amendemtn to the Federal Constitution to require, with certain exceptions, that the total of all federal appropriations may not exceed the total of estimated federal revenues in any fiscal year.”

     2.   1980 –  HJR 1045 reads:

“A joint resolution concerning the federal judiciary; applying for a Constitutional Convention to amend the constitution of the United States to provide for state removal of Federal Judges; encouraging other states to take similar actions; making application permanent; and directing distribution… Section 3 Nature and duration application – This application shall constitute a continuing application for a Constitutional Convention, pursuant to Article V of the Constitution of the United States.  This application shall remain effective until the Legislatures of two-thirds (2/3) of the states shall have made like applications, which are unrescinded, and a Constitutional Convention shall have been called by the Congress of the United States.”

Reports vary on how many states have viable calls for a Con/Con. Some state 32 of the required 34 (2/3 of the states) have active calls, and other reports indicate 10 of those states have rescinded their calls.

Whichever is accurate, Oklahoma is now officially in the latter group.  Good for us all.
